When Legolas recounts the event at the Council of Elrond, he states that it was an orchestrated event between Sauron and Gollum to ensure Gollum's escape. He states that Gollum had been allowed to climb a tree, and at this time, Orcs from Dol Guldur ambushed them, and all of Gollum's guards were either captured or slain.
This is the earliest event in the War of the Ring.
